Digital Currency Group (DCG) and its CEO Barry Silbert want a US court to dismiss a fraud lawsuit filed by Gemini Trust Inc., a crypto exchange run by the Winklevoss twins.
They submitted a motion to dismiss in Manhattan federal court on Thursday. They say that Gemini has not made a valid fraud claim and that they are being unfairly attacked by Gemini and its founders Cameron and Tyler Winklevoss.
Gemini accused DCG and Silbert of fraud and deception in New York last month.
The conflict arose when Genesis Global Holdco, a crypto lending branch of DCG, stopped allowing withdrawals in November.
This locked up hundreds of millions of dollars worth of Gemini customer assets.
The motion to dismiss argues that Gemini has not shown any proof of fraud or intent to defraud by DCG or Silbert.
It also states that DCG and its CEO had no role in running or managing the Gemini Earn program.
